Kinds Of Intellectual Property

Tangible assets like a shop, jewellery, currency, investments, car etc are not the only types of property that one can own and claim safeguards under the law. There are other types of property too which are provided for by law and protected within the legal framework and these are called intellectual property, which can be secured against infringement. The three primary kinds of intellectual property rights are patents, trademarks and copyrights.

Copyrights are intellectual property dealing with rights of an author or an artist over his or her original creation. This right may be given for songs, films, videos and other types of artistic expressions and not just the written or printed material. Under copyright law, the owner of the work gets a number of rights which include monetary rights to income arising from the work and acceptance as sole owner of that work.

On the other hand, trademarks accord the one who has registered it, the protection over certain symbols, text or marks which point to the creator or source of products to prevent replication and thus infringement. Trademark protection gives the owner complete safety from unscrupulous use of his own symbol by others to mislead customers.

The last intellectual property right is a patent, which is bestowed upon inventors to protect their original and beneficial creations and inventions. It gives them sole right of use and sale of their work for a specific period.

There are some other intellectual property rights too which are less often registered and used. Some examples of other kinds are traditional understanding possessed by inhabitants of a specific region that is unique only to that area; trade secrets that include company secrets, for instance, KFC’s recipe; and positional pointers that are a variant of trademarks used for products arising from a particular part of the world, for instance Champagne.

Though these types of intellectual property are separate from each other there are certain commonalities between the three. All of these are protected within the provisions of the law and the rightful holders can take refuge in a court of law and claim compensation in case of any violation.
